AFTER THAT MEETING, WHEN FINANCE STAFF WAS GOING THROUGH EVERYTHING CONCERNING THAT, IT WAS DETERMINED THAT THERE WERE THREE OF THE NONRESIDENTIAL RATES. SO NOTHING RESIDENTIAL, JUST THREE NON RESIDENTIAL RATES WERE NOT EXACTLY AS THEY SHOULD HAVE BEEN COMPUTED IN THAT RESOLUTION ON THE SCHEDULE THAT WAS THERE. OKAY. SO AND THEY WERE IN PARTICULAR THEY WERE NOT AS THEY SHOULD HAVE BEEN PURSUANT TO WHAT OUR FEE CONSULTANT WHO HAD GONE THROUGH AND DONE ALL THE STUDIES AND EVERYTHING, THEY DID NOT CALCULATE OUT EXACTLY AS THEY SHOULD HAVE. THOSE THREE NUMBERS WERE THE GENERAL SERVICES, NONRESIDENTIAL WATER CONSUMPTION RATE. SO AGAIN, NOT FOR RESIDENTIAL, JUST FOR ANYTHING NON RESIDENTIAL LIKE COMMERCIAL AND SO ON. THE RATE THAT WAS ADOPTED WAS $2.96 PER 1000 GALLONS. BUT PURSUANT TO THE CALCULATIONS AS IT SHOULD HAVE BEEN WORKED OUT FROM THE CONSULTANT, IT ACTUALLY SHOULD HAVE BEEN $3.43. AS OF THE DATE OF REFERENDUM, BECAME ORDINANCES OF THE VILLAGE ALL RIGHT THAT THE VILLAGE COUNCIL COULD THEN CHANGE, MODIFY, REPEAL AND WHAT HAVE YOU. IT DID SIMILAR THINGS. SO THAT'S REGULAR ORDINANCES. IT DID SIMILAR THINGS FOR THE MARTIN COUNTY COMPREHENSIVE PLAN, WHICH IS KIND OF THE BIG PICTURE. LAND USE PLANNING FOR THE COUNTY OR FOR THE VILLAGE AND FOR THE MARTIN COUNTY LAND DEVELOPMENT REGULATIONS, BECAME THE VILLAGE'S TRANSITIONAL LAND DEVELOPMENT REGULATIONS OVER THE LAST MANY YEARS, THE VILLAGE HAS DONE A LOT OF LEGISLATIVE WORK COMING UP AND FOCUSED PRIMARILY ON LAND USE THINGS. COMING UP FIRST WITH THE VILLAGE'S OWN COMPREHENSIVE PLAN, WHICH IT WENT THROUGH, AND THEN EVENTUALLY ADOPTED, WHICH REPEALED MARTIN COUNTY'S COMPREHENSIVE PLAN. AND THE VILLAGE HAS ITS OWN SIMILARLY WITH THE LAND DEVELOPMENT REGULATIONS WENT THROUGH PROCESS, THERE, ADOPTED LAND DEVELOPMENT REGULATIONS. AS YOU ALL KNOW, WE'VE SUBSEQUENTLY AMENDED THOSE REGULATIONS. WE'RE GOING TO BE DOING MORE OF THAT. BUT WE DO HAVE THAT WHOLE SET OF MARTIN COUNTY TRANSITIONAL ORDINANCES THAT ARE THE ORDINANCES OF THE VILLAGE RIGHT NOW. OKAY. WE HAVE A FINE SCHEDULE SET OUT IN THIS ORDINANCE WITH VERY TYPICAL SORT OF CLASSES OF FINES. THE LIST I'LL THROW IT UP HERE REAL QUICK JUST SO YOU ALL SEE, THE LIST IS VERY SHORT. SO HERE WE'VE GOT THIS IS A TABLE OF DIFFERENT VIOLATIONS THAT A CODE ENFORCEMENT OFFICER COULD GIVE OUT A CITATION FOR THE I THINK THE LOWEST HANGING FRUIT ONES BEING MOBILE FOOD VENDORS OR FOOD TRUCKS WITHOUT A LICENSE OR PERMITS, PEDDLERS OR ITINERANT MERCHANTS WITHOUT A PERMIT, AND FAILURE TO OBTAIN A REQUIRED BUILDING PERMIT. THERE ARE A LOT OF DIFFERENT WAYS TO DEAL WITH FAILURE TO OBTAIN A BUILDING PERMIT, BUT IF THE APPROPRIATE WAY, AMONG ALL THE TOOLS TO A CODE ENFORCEMENT OFFICER AND SO ON, IS TO ISSUE A CITATION, THEY HAVE THAT TOOL NOW AVAILABLE TO THEM. HOW MANY CODE ENFORCEMENT OFFICERS DO WE CURRENTLY HAVE OR DO YOU FORESEE US NEEDING? WE HAVE TWO. WE HAD ONE. AND THEN I CAME TO THE COUNCIL. WHEN THE COUNCIL DECIDED THAT CODE ENFORCEMENT WAS SHOULD BE A PRIORITY, WE CONVERTED ANOTHER POSITION INTO A CODE ENFORCEMENT OFFICER. SO WE HAVE TWO AND THEY'RE BOTH FAIRLY NEW TO THE VILLAGE, BUT THEY'RE BOTH YOU KNOW, THEY'RE DOING AN AWESOME JOB. WHAT'S SOMETHING LIKE THE CITATION CITATION PROGRAM DOES IS IT ALLOWS THEM TO DEAL WITH THE PERSON THAT'S CREATING THE VIOLATION, RATHER THAN GIVING A NOTICE TO A HOMEOWNER THAT DOESN'T LIVE THERE AND IS NOT CREATING THE PROBLEM. OKAY, IT IS ULTIMATELY UNDER FLORIDA LAW, THE LANDLORD IS RESPONSIBLE FOR THE CONDITION OF THEIR PROPERTY, EVEN IF IT IS THE TENANT THAT DID IT. NOW, I WILL TELL YOU IN SOME JURISDICTIONS THE A CITATION PROCESS IS SOMETIMES USED TO CITE A TENANT. ALL RIGHT. SO PUTTING A DIRECT FINANCIAL BITE ON THE TENANT SO THEY HAVE SOME SKIN IN THE GAME OTHER THAN JUST THE LANDLORD YOU KNOW BEING ABOUT THEM. SO IT'S AN ADDITIONAL TOOL TO PUT SOME PRESSURE ON THE TENANT DIRECTLY. THE TOOL TO PUT PRESSURE ON THE LANDLORD IS THE TRADITIONAL CODE [01:20:01] ENFORCEMENT PROCESS TO SAY, HEY, I DON'T CARE IF YOU DID IT OR YOUR TENANT DID IT, YOU'RE RESPONSIBLE FOR IT. MAKE YOUR TENANT CLEAN IT UP, OR YOU'RE GOING TO LOSE YOUR PROPERTY BECAUSE IN THE END, THAT IS WHEN YOU GO ALL THE WAY TO ALL THE STEPS AND FOLKS REFUSE TO BRING IT INTO COMPLIANCE. AND YOU GO THROUGH EVERYTHING. THE BIG HAMMER WITH TRADITIONAL CODE ENFORCEMENT IS THAT FINE RUNS WHEN THAT FINE RUNS UP TO A SUBSTANTIALLY LARGE NUMBER, THE VILLAGE CAN GO AND GET FORECLOSURE OF THE LIEN OF THAT FINE AUTHORIZED, THEN ACTUALLY GO INTO COURT AND FORECLOSE IT. OKAY, NOW YOU DON'T HAVE TO DO THAT. THAT'S A JUDGMENT CALL. SOME JURISDICTIONS ARE VERY AGGRESSIVE ON IT. SOME JURISDICTIONS AREN'T. SOME JURISDICTIONS DO IT WHEN YOU HAVE A PARTICULARLY BAD PROBLEM PROPERTY. LIKE FOR EXAMPLE, I THINK MOST OF YOU KNOW, COMMISSIONER OR COUNCIL MEMBER ANSLINGER MAY NOT KNOW. IT WAS RECENTLY THE CASE THAT A MANY YEAR LONG STANDING PROBLEM PROPERTY IN BOOKER PARK WAS ULTIMATELY BROUGHT TO THE POINT WHERE THE VILLAGE DID FORECLOSE THE LONG RUNNING CODE ENFORCEMENT LIEN BECAUSE IT WAS JUST A HORRIBLE PROBLEM IN THAT AREA, AND IT HAD CODE ENFORCEMENT PROBLEMS WITH MARTIN COUNTY ALL THE WAY BACK TO BEFORE THE VILLAGE WAS INCORPORATED. BUT IN ANY EVENT, THAT THAT IS, AGAIN, ONE OF THE MANY TOOLS THAT'S AVAILABLE. OKAY, OKAY. AND THAT THAT'S THAT'S WHAT THIS WHOLE CITATION PROGRAM WAS MEANT TO DO, TO BE ABLE TO GIVE ANOTHER TOOL THAT WE'VE BEEN WORKING ON THIS FOR A WHILE. I'M FINALLY GLAD TO SEE IT COME, COME THROUGH, BECAUSE THAT WAY THEY'LL HAVE THEY'LL HAVE AN EXTRA TOOL TO BE ABLE T, YOU KNOW, WHEN YOU GIVE SOMEBODY A CITATION, WHEN SOMEBODY'S DOING SOMETHING THAT THEY SHOULDN'T BE DOING AND YOU GIVE THEM A CITATION RIGHT THEN AND THERE, THERE'S SOMETHING PSYCHOLOGICAL ABOUT THAT. SO I'M HOPING I'M I'M VERY, VERY CONFIDENT THAT THAT CITATION PROGRAM IS GOING TO WORK. WELL. AND, YOU KNOW, FOR THE FOR THE HOMEOWNERS. YEAH. WE NEED TO KEEP THE PRESSURE ON THE HOMEOWNERS TO RENT THE RENT COLLECTORS BECAUSE WE'VE GOT A LOT OF PROPERTIES WITH A LOT OF CARS PARKED ALL OVER THE PLACE. AND AT SOME POINT WE'RE GOING TO HAVE TO ADDRESS ALL THAT, YOU KNOW, CRACKING SIDEWALKS AND. TEARING UP GRASS AND EVERYTHING ELSE. BUT BUT I'M GLAD TO FINALLY SEE IT COME. I HAVE A QUESTION IN THIS ARRAY OF TOOLS THAT HE HAS WHEN THE TENANT IS GIVEN A CITATION, DOES THE LANDOWNER RECEIVE ALSO NOTICE THAT THE TENANT HAS A CITATION?
