THAT ORDINANCE HAD ALREADY BEEN THROUGH MULTIPLE ROUNDS OF FEEDBACK FROM THE VILLAGE COUNCIL AND FROM MEMBERS OF THE PUBLIC AT THAT JULY PCB MEETING. THE PCB HAD A GOOD DEAL OF DISCUSSION AND RECEIVED A LOT OF INPUT FROM MEMBERS OF THE PUBLIC. A LOT OF GOOD FEEDBACK THAT, PCB ASKED THAT STAFF GO BACK, TAKE THAT DISCUSSION. INTO CONSIDERATION, AND, TRY TO IMPLEMENT SOME REVISIONS BASED ON THOSE DISCUSSIONS. BRING IT BACK TO THE PCB ONE MORE TIME BEFORE IT COMES OUT OF THE PCB, AND GOES TO VILLAGE COUNCIL FOR ITS ACTION ON IT. AT TWO READINGS ON THE ORDINANCE, BASED ON THAT DISCUSSION AT YOUR MEETINGS, WE WENT BACK AND INCORPORATED A NUMBER OF THE, OR MADE A NUMBER OF REVISIONS THAT WERE INCORPORATED TO ATTEMPT TO ADDRESS SOME OF THE CONCERNS THAT WERE RAISED AT THE PCB MEETING, RESULTING IN THE DRAFT. THAT'S BEFORE YOU TONIGHT, WE HAD COPIES RUN OFF OF THE ORDINANCE, AND THIS WAS IN THE AGENDA ITEM AS WELL. BUT OF A MICROSOFT WORD GENERATED RED LINE SHOWING IN RED EVERYTHING THAT HAD BEEN ADDED OR CHANGED COMING OUT OF THAT PCB MEETING, IN THE AGENDA ITEM, WE HAVE A RUNDOWN OF THE DRAFT REVISIONS THAT WERE INCORPORATED BASED ON THE DISCUSSION AT THE LAST PCB MEETING. BUT ANY TIME THERE IS, FOR EXAMPLE, STREET CLOSING, OFF SITE PARKING, AMPLIFIED ENTERTAINMENT, VILLAGE CO-SPONSORSHIP, CROWD ATTENDANCE IN EXCESS OF 1500, OR FIREWORKS DISPLAY IN ANY OF THOSE INSTANCES, IT REQUIRED THAT A SPECIAL EVENT HAD HAD TO GO BEFORE THE VILLAGE COUNCIL, CENTRAL TENET OF WHAT THE VILLAGE COUNCIL WANTED TO GO IS THEY WANTED IT TO BE PRIMARILY HANDLED AS A STAFF MATTER. SO, BUT AT THE SAME TIME, PCSB HAD A CONCERN THAT IN THE EVENT OF A DENIAL THAT THERE BE AN OPPORTUNITY TO APPEAL TO THE VILLAGE COUNCIL. SO LANGUAGE HAS NOW BEEN ADDED TO PROVIDE FOR APPEAL OF PERMIT DENIALS TO THE VILLAGE COUNCIL. THE HOPE WOULD BE THAT PERMITS THAT GO THROUGH AND EVERYTHING IS GOOD AND SORTED AND SO ON, NEVER HAVE TO END UP IN THE VILLAGE COUNCIL. BUT THERE IS THAT ADDITIONAL PIECE THAT'S BEEN ADDED TO THE DRAFT THAT WILL BE TRANSMITTED AS A RECOMMENDATION TO THE VILLAGE COUNCIL. IN ADDITION, THERE WAS THE ADDITION OF ANOTHER EXCLUSION, IF YOU RECALL FROM THE DISCUSSION LAST TIME, TO TRY TO MAKE THIS, THERE ARE A NUMBER OF WAYS THERE WERE ATTEMPTS TO MAKE THIS ORDINANCE, CLEARER, BUT AT THE SAME TIME, FRANKLY MORE LENIENT, CUTTING OUT OR EXEMPTING WHOLE CATEGORIES OF ACTIVITIES TO MAKE IT CRYSTAL CLEAR. HEY, FOR THESE THINGS, YOU DO NOT HAVE TO COME IN AND GET A SPECIAL EVENT PERMIT. WE HAD A WHOLE LIST OF THESE THAT HAVE BEEN ADDED. IF YOU RECALL. SO, WE ADDED AN ALTERNATIVE TO PROVIDE THAT PROOF OF APPLICATION FOR LIABILITY INSURANCE HAD BEEN MADE RATHER THAN ACTUALLY PAYING FOR ACTUALLY GETTING THAT INSURANCE ISSUED. JUST TO DEMONSTRATE THAT YOU'VE EXPLORED. YEAH, YOU CAN GET THIS INSURED AND YOU HAVE IT ALL WORKED OUT, BUT YOU HAVEN'T SPENT THE MONEY YET. I DON'T KNOW IF THERE'S I DON'T KNOW IF IT'S MORE SO OF A QUESTION, BUT AFTER READING OVER ALL OF THE INFORMATION, I AM PLEASED TO SEE THAT SOME OF THE CONCERNS THAT WE ADDRESSED WERE, PUT IN THIS IN, IN WRITING. ONE OF MY CONCERNS, THOUGH, IS THE FACT THAT THEY CHANGED FOR THE APPEAL PROCESS. THEY WENT FROM FIVE DAYS TO THREE DAYS. AND, AND HEAR WHAT PEOPLE HAVE TO SAY ABOUT, YOU KNOW, WHY WE THINK YOU LOOKED AT THIS WRONG OR WHAT HAVE YOU. AND THE VILLAGE MANAGER WOULD BE DOING THAT. THERE'S NO THERE'S NO RIGID TIMETABLE FOR THE VILLAGE MANAGER. WHEN THE VILLAGE MANAGER IS GOING TO SIT AND LOOK AND THINK ABOUT SOMETHING, YOU SEE WHAT I'M SAYING? AS OPPOSED TO THE VILLAGE COUNCIL, THE VILLAGE COUNCIL HAS TO COMPLY WITH THE SUNSHINE LAW, HAS TO MEET WITHIN THEIR REGULAR MEETING SCHEDULE AND ALL OF THIS. SO THE ONLY REASON THAT THAT TWEAK WAS MADE THERE WAS TO TIGHTEN IT UP A LITTLE BIT, TO TRY TO GIVE IT A BETTER CHANCE THAT IT'S GOING TO GET ON AN AGENDA, WITHIN A REASONABLE PERIOD OF TIME. SO IT'S NOT BUMPING OUT WEEKS AND WEEKS BECAUSE THEY WAIT FOR THE FULL FIVE DAYS. YOU MIGHT END UP IN THE SITUATION WHERE IT MISSED AN AGENDA DEADLINE AND THEN IT'S GOING WAY FAR OUT. IT CAN GO BACK. WE'VE ALSO HAD A COUPLE OF NEW APPLICATIONS IN FOR RIVER OAK, SITE PLAN AMENDMENT TO RECONFIGURE A COUPLE OF LOTS AND CHANGE A FEW SIZES ON THE LOTS. AND THEN CONCURRENT WITH THAT, THEY'VE ALSO GOT THEIR PLAT APPLICATION SO THEY CAN GO AHEAD. AND IF THEY WANT TO, THEY CAN ACTUALLY SELL INDIVIDUAL LOTS ON THAT ONE. THAT'S CONSISTENT WITH THE MASTER SITE PLAN APPROVAL THAT WAS APPROVED BACK IN THE DAY WITH MARTIN COUNTY. SO THE APPLICANT AGENTS AND PROPERTY OWNERS HAVE COME IN FOR, THAT SITE TO BE DEVELOPED FOR THE, YOU KNOW, CONSISTENT WITH THE CONSISTENT WITH THE MASTER SITE PLAN, SO THAT'S AN EXCITING ONE AS WELL.
