MARINE INDUSTRY REPRESENTATIVES CONCERNING THE LAWSUIT AGAINST ARMY CORPS OF ENGINEERS U S COAST GUARD AND FLORIDA EAST COAST RAILWAY. MR BOSE. THANK YOU VERY MUCH. MAYOR, COUNCIL MEMBERS. GOOD EVENING. UM AS YOU ALL RECALL AT YOUR LAST REGULAR MEETING, THE COUNCIL SCHEDULED A SPECIAL MEETING FOR TONIGHT TO DISCUSS A REQUEST HAD BEEN MADE FROM MEMBERS OF THE INDIAN TAMARIN INDUSTRY. THEY WERE ASKING THAT THE VILLAGE JOINED THEM AS A PLAINTIFF IN THE LAWSUIT THAT THEY HAVE NOW FILED AGAINST THE U. S ARMY CORPS OF ENGINEERS. U. S COAST GUARD. AND THE FLORIDA EAST COAST RAILWAY THAT'S RELATED TO PLAN MODIFICATIONS TO THE STUART RAILROAD BRIDGE DRAWBRIDGE SCHEDULE THAT WILL ACCOMMODATE BRIGHT LINE OPERATIONS, BUT WE'LL ALSO HAVE NEGATIVE EFFECTS ON THE FREE NAVIGATION OF THE OKEECHOBEE WATERWAY. UM YOU SCHEDULED THIS MEETING FOR TONIGHT, MR. UH DAN ROMANCE WITH INDIAN TO MARINE CENTER IS HERE AND I BELIEVE LIKE TO SPEAK TO YOU ALL CONCERNING THAT REQUEST. AS YOU ALL WILL RECALL FROM THE LAST MEETING. WE HAD. HEARD INITIAL INFORMATION ABOUT ABOUT THIS REQUEST AND HAD A RELATIVELY SHORT TIME TO TAKE A LOOK AT ALL THAT. AND HAD URGED THAT THAT TIME PERHAPS IT WOULD BE WISE TO HAVE A LITTLE BIT MORE TIME TO TAKE A LOOK AT ALL THE DIFFERENT OPTIONS AND, UM POTENTIAL. AH, UM. BUT AS WE WERE DISCUSSING AND EVALUATING THE CIRCUMSTANCES OF THE VILLAGES AND ALL THE OPTIONS AVAILABLE TO US, AND THE FACT THAT I CAN TELL YOU FROM 20 YEARS AS A LITIGATOR, THAT ALL SORT OF EXTERNALITIES AND UNINTENDED CONSEQUENCES CAN ARISE FROM LITIGATION, PARTICULARLY VERY PUBLIC LITIGATION. OUR RECOMMENDATION.

WHAT IT DOES IS LAY OUT THE HISTORY AND LAY OUT THE CURRENT CIRCUMSTANCES OF WHAT IS GOING ON. UM HAS A BRIEF DESCRIPTION OF WHAT IT IS THE INDIAN TOWN MARINE INDUSTRY, TOGETHER WITH OTHER LEADERS FROM THE TREASURE COAST MARINE INDUSTRY ARE DOING CONCERNING IT AND THEN ULTIMATELY EXPRESSING SUPPORT FOR THEIR EFFORTS TO MAINTAIN THE FREE NAVIGATION OF THE OKEECHOBEE WATERWAY AND TO AVOID THE HARMS THAT WOULD COME FROM THE OBSTRUCTION. TO THE FREE NAVIGATION OF THE OKEECHOBEE WATERWAY TO PROPERTY OWNERS TO BUSINESS OWNERS TO RESIDENTS AND TO THE VILLAGE AND THE VILLAGE IS TAX BASE. SO WITH THAT, MAYOR, IF YOU DON'T MIND, I'LL GO AHEAD AND TURN IT OVER TO MR ROMANCE. YES, PLEASE.

OUR COMPANY ALONG WITH 12, OTHER PLAINTIFFS. FILED A LEGAL ACTION AND SOUTH FLORIDA FEDERAL COURT. AGAINST THE FLORIDA EAST COAST RAILROAD. THE U. S. ARMY CORPS OF ENGINEERS. UNITED STATES COAST GUARD REGARDING THE ISSUE THAT I WAS HERE. DISCUSSING AT THE LAST MEETING ON THURSDAY. ON MONDAY, WE HELD A PRESS CONFERENCE THAT WAS ATTENDED UPON OUR INVITATION BY CONGRESSMAN BRIAN MAST. WHO AH! SPOKE VERY CLEARLY AND STRONGLY IN SUPPORT OF OUR ACTION AS WELL. AND UNLESS THERE'S ANYBODY OPPOSED, I'D LIKE TO READ SOME OF THE REMARKS THAT I MADE AT THAT TIME JUST FOR THE RECORD AND TO BUT YOU ALL KNOW EXACTLY WHAT WE'RE DEALING WITH WITH OUR ACTION. YES, SIR. PLEASE. OKAY OUR COMPANY ANYTOWN MARINE CENTER ALONGSIDE MANY OTHER MARINE COMPANIES REPRESENTED BY THE PEOPLE STANDING HERE, WHICH WERE THE PEOPLE THAT WERE WITH US THAT BUTTER REPRESENTATIVES FROM ALL THE OTHER PLAINTIFFS WAS THERE. FILED SUIT AGAINST THE FLORIDA EAST COAST RAILWAY, THE UNITED STATES COAST GUARD THE UNITED AND THE UNITED STATES ARMY CORPS OF ENGINEERS. FOR 96 YEARS, THE FTC DRAWBRIDGE HAS BEEN IN THE OPEN POSITION BY LAW TO ACCOMMODATE MARINE TRAFFIC. HOWEVER, THAT IS SOON GOING TO CHANGE. WE DIDN'T WE WANT TO MAKE CLEAR THAT WE DID DID NOT GO LOOKING FOR THIS FIGHT, BUT ONLY AFTER OUR NUMEROUS ATTEMPTS TO ACHIEVE A FAIR AND EQUITABLE OUTCOME WERE REBUFFED AND IGNORED. DID WE FINALLY TAKE THE STEP OF DEFENDING OUR LIVELIHOODS, PUBLIC SAFETY AND THE BASIC RIGHTS THAT EVERY VOTER IS ENTITLED TO THIS IS AN ISSUE OF BUSINESS OF A BUSINESS COMMUNITY STANDING UP AGAINST A LARGE, WELL FUNDED, WELL REPRESENTED PRIVATE CORPORATION.

AND TWO VERY LARGE AGENCIES OF THE FEDERAL GOVERNMENT. THIS IS THE PROVERBIAL BIG CORPORATION CONTROLLING THE GOVERNMENT. AND THEN COMES THE SUMMARY OF OUR CASE IS VERY STRAIGHTFORWARD.

THE FLORIDA EAST COAST RAILWAY IS THE OWNER OF THE RAILROAD DRAWBRIDGE AT MILE 7.4 AND THE OKEECHOBEE WATERWAY WHERE INDIAN TOWN MARINE CENTER INDIAN TOWN MARINA AS WELL AS MANY OTHER BUSINESSES INVOLVED. UTILIZE. AND. THE DAILY OPERATION OF OUR BUSINESS. THIS IS THE ONLY WATERWAY THAT ALLOWS NAVIGATION ACROSS THE STATE OF FLORIDA, MAKING IT VITAL FOR COMMERCE AS WELL AS PLEASURE BOATING. FLORIDA EAST COAST RAILROAD BY ALLOWING BRIGHT LINE TO UTILIZE THIS DRAWBRIDGE AND ITS PLAN TO EXTEND RAIL SERVICE TO ORLANDO. IS CONDONING AND CONTRIBUTING TO

AN OBSTRUCTION TO NAVIGATION OF A FEDERALLY REGULATED WATERWAY. THAT OBSTRUCTION IS NOT INSIGNIFICANT, PROBABLY NOT BRIGHT LINE HAS ANNOUNCED AND INTENDS TO ADD 32 TRAINS A DAY TO THE RAIL TRAFFIC CROSSING THE DRAWBRIDGE. THAT NUMBER WE ESTIMATE WOULD BRING THE TOTAL NUMBER OF TRAINS A DAY TO 50. RIGHT NOW, THERE'S 12. I GET COMPLAINTS FROM CUSTOMERS ABOUT STANDING IN LINE AT THE DRAWBRIDGE WHEN THERE'S 12 TRAINS, AND NOW THEY'RE GOING TO JUST ABOUT QUADRUPLE THAT. THIS ANTICIPATED ITS OBSTRUCTIONISM PICKED AND IS IMPACTING THE LOCAL ECONOMY. FLORIDA EAST COAST RAILWAY IS VIOLATING A FEDERAL LAW THAT PROHIBITS ANY ENTITY FROM OBSTRUCTING THE FREE NAVIGATION OF THE WATERWAYS. UNITED STATES WE SEEK INJUNCTIVE RELIEF TO PREVENT FCC FROM ALLOWING BRIGHT LINE, A PRIVATELY OWNED COMPANY THAT IS STARTING A NEW RAIL SERVICE PASSENGER RAIL SERVICE. TO IMPLEMENT THEIR DECLARED DECLARED PLAN TO RUN A FULL SCHEDULE OF TRAINS OVER THE BRIDGE STARTING THIS SUMMER. WE ALSO SEEK DECLARATORY JUDGMENT THAT THE U. S COAST GUARD AND THE U. S. ARMY CORPS OF ENGINEERS HAVE A DUTY TO PREVENT THIS OBSTRUCTION FROM OCCURRING AS FEDERAL LAW CHARGES THE TWO AGENCIES WITH ENSURING THE NAVIGABLE WATERS, UNITED STATES REMAIN UNOBSTRUCTED. THERE ARE RULEMAKING PROCEDURES. THAT MUST BE FOLLOWED BEFORE CHANGES TO BREAK REGULATION CAN OCCUR. RIGHT NOW. THE REGULATION ON THAT BRIDGE SAYS THAT BRIDGE NEEDS TO BE OPEN. AND IF THERE'S A TRAIN, IT GOES DOWN. AS SOON AS THE TRAIN HAS PASSED, IT COMES BACK UP. THAT MEANS THAT WHEN BRIGHT LINE STARTS THEIR SERVICE, THERE'S GOING TO BE 50 TRAINS, RUNNER OF INTERNET BRIDGE IS GOING TO BE DOWN. FOR BRIGHT LINE TO BE PROFITABLE. THE BRIDGE WILL NOW BE FORCED TO BE PRIMARILY IN THE CLOSED POSITION. THIS CHANGE WILL SERIOUSLY OBSTRUCT THE EFFICIENT MOVEMENT OF COMMERCIAL AND RECREATIONAL MAIN TRAFFIC. WE BELIEVE IT WILL NEGATIVELY IMPACT A MULTITUDE OF MARINE RELATED SERVICE BUSINESSES. REDUCE PROPERTY VALUES AND RESULT IN AN OVERALL UNSAFE VOTING CONDITION AT THE BRIDGE. OUR SEATS ARE SUIT SEEKS TO COMPEL THE UNITED STATES COAST GUARD AND THE ARMY CORPS OF ENGINEERS TO ACT AS REQUIRED BY FEDERAL LAW. TO PROVIDE RELIEF FROM THE HARM OF THE WATERWAY OBSTRUCTION. THIS IS A TEMPORARY SOLUTION. THE FINAL SOLUTION IS TO BUILD A LIGHT RAIL BRIDGE THAT WILL ALLOW PASSENGER TRAINS AND MARINE TRAFFIC TO PASS UNOBSTRUCTED. EVERY OTHER BRIDGE UP AND DOWN THE EAST COAST. UNITED STATES HAS AMENDMENT A MINIMUM VERTICAL HEIGHT REQUIREMENT. ■IT SAYS THAT THE TRAINS HAVE TO GO OVER THAT BRIDGE, AND IT ALLOWS MARINE TRAFFIC TO PASS WITHOUT ANY DRAWBRIDGE. THAT'S JUST ABOUT EVERY OTHER BRIDGE ON THE EAST COAST. THE TRI RAIL OPERATES SEVERAL PASSENGER TRAINS A DAY ON THE CSX TRACK. THAT CLEAR THE MINIMUM VERTICAL HEIGHT FOR MARINE TRAFFIC TO PASS WITHOUT A DRAWBRIDGE. AND I REMIND YOU BRIGHT LINE IS NOT PUBLIC TRANSPORTATION. THIS IS A PRIVATE RAILROAD. MOST OF THE PLAINTIFFS HAVE ALREADY EXPERIENCED DAMAGE TO THEIR BUSINESSES. THE TREASURE COAST HAS A LONG HISTORY OF ENJOYING OUR WATERWAYS IS INGRAINED IN OUR CULTURE AS WELL AS VITAL TO OUR ECONOMY. OUR SUIT SEEKS TO PROTECT THE HEALTH, LIFE AND SAFETY OF VOTERS, HOMEOWNERS AND MARINE BUSINESS OWNERS AND THEIR EMPLOYEES AND FAMILIES. THE OTHER ISSUE IS THAT THE BRIDGE IS PRESENTLY DOWN FOR MAINTENANCE, WHICH THEY SAY IS NEEDED IN ORDER FOR IT TO BE ABLE TO CARRY THE NUMBER OF TRAINS. THAT WILL NEED IT TO GO NEED TO BRIDGE TO OPERATE. IN OTHER WORDS, GO FROM UP TO DOWN, UP AND DOWN. AND THAT WILL BE SUBSTANTIAL. UH, AS TO WHEN BRIGHT LINE IS GONNA COMMENCE WITH THEIR SERVICE. THEY'VE DECLARED PUBLICLY THAT IT SOMETIME THIS SUMMER. PEOPLE HAVE SAID AS EARLY AS SOMETIME IN JUNE. THEY'RE ALSO ADVERTISING THAT THEY HAVE TICKETS PRESENTLY FOR SALE. AND WHEN THEY DO THAT, THEY ADVERTISE THAT THEY WILL BE MAKING 32 TRAINS. 32 TRAINS WILL BE RUNNING. ON THAT LINE. PROVIDING THEIR SERVICE TO ORLANDO, WHICH MEANS 32 TRAINS.
