UM SO AGAIN IN 2007 WHEN THE PUY DE AGREEMENT WAS APPROVED THE DEVELOPMENT POTENTIAL AT THE TIME OF THE MAXIMUM THAT WAS DISCUSSED AT THE TIME WAS 750,000 SQUARE FEET OF. OF DEVELOPMENT POTENTIAL ON THE 138 ACRES. UM AND JUST A LITTLE OTHER HISTORY WHEN THE VILLAGE INCORPORATED THIS IS WHY WE'RE GOING TO HAVE THE REZONING THE NEXT ITEM WHEN THE VILLAGE OF INCORPORATED ON LEE 81 OF THOSE ACRES OF THOSE 138 WERE ACTUALLY BUT IN THE VILLAGE BOUNDARIES AND THAT WAS BASICALLY AN ERROR. SO THAT'S WHY WE'VE CORRECTED THE MUNICIPAL BOUNDED TO ANNEX THE REMAINING 50 SOME ACRES TO THE NORTH. WHICH IS THE PART IN BLUE ON ON THIS ON YOUR DIAGRAM ON PAGE THREE OF MY REPORT PAGE 12 OF THE AGENDA SO, BUT THIS THIS ENCOMPASSES WHAT WE'RE DOING TONIGHT. THE WHOLE 138 ACRES. SECOND AMENDMENT, WHICH WAS APPROVED ON APRIL 12 2011 HAVE SPECIAL HAD SPECIAL CONDITIONS DEALING WITH FIRE PROTECTION. UM COMPLETION OF THE SIDEWALK. ON FOX, BROWN OR IMPACT. DR. UM.

DESTRUCTION OF TURN LANES ON. NEAR 7, 10 AND ALSO. THE CONDITIONS DEALING WITH WATER AND SEWER. UM. AND ALLOWING THEM TO HAVE YOU KNOW CERTAIN? WHAT'S THAT ORDERED SOUP? SO WE REVIEWED THE PROPOSALS BASED ON THAT ON THOSE SECTIONS OF OUR NEW LD OURS. I COULD TELL YOU WE MET AND DISCUSSED THIS DECISION USE THE CHANGES MANY TIMES WITH THE APPLICANT AND HIS REPRESENTATIVE. UM SO WE'RE PRETTY COMFORTABLE IN THE CHANGES ON AND WE'RE GOING, TOMO. YOU KNOW, REQUEST THAT YOU RECOMMEND APPROVAL TO THE COUNCIL, SO I'M JUST GONNA GO THROUGH BRIEFLY. SOME OF THE.

TIMETABLE. THEY HAVE TO DO CERTAIN IMPROVEMENTS TO FATS BROWN, RUDE ON DEAL WITH THE FIRE PROTECTION PRIOR TO 28 DELIGHT 13 2022 OR. BY THE FIRST CERTIFICATE OF OCCUPANCY.

IF A NEW BUILDING IS GOING TO BE BUILT SHORTLY. SO BASICALLY IN IN THE AGREEMENT THERE 14 CENTS OF CONDITIONS DEALING WITH DIFFERENT TOPICS. YOU KNOW, STORM WARNER ENDANGERED SPECIES, WHICH IS WHAT'S CALLED A PRESERVATION AREA MASTER PLAN THAT HAS NOT CHANGED SINCE THE VERY BEGINNING THAT STILL A PART OF THIS AGREEMENT, SO EVERY EVERYONE THAT COMES INTO DEVELOPED HAS TO ABIDE BY THAT DOCUMENT, SO NOTHING'S CHANGED WITH THAT. FIRE PROTECTION WHAT WE REQUESTED ON THAT SECTION THAT SUBSECTION THE WAY IT WAS WATER SO AND FIRE PROTECTION.

I'M SORRY. WATERS YES. WHAT IS SO AND FIRE PROTECTION ANY UM, THEY THEY WOULD HAVE TO WAIT UNTIL WATER AND SEWER AND FIRE PROTECTION THE WATER WITH EXTENDED TO WITHIN 150 FT OF THE PROPERTY. WE REQUESTED THAT THEY AGREED TO IF THE WATER WATER LINES ARE EXTENDED WITHIN A QUARTER MILE OF THE PROPERTY THAT THEY WOULD HAVE TO CONNECT. SO THEY HAVE AGREED TO THAT. THAT CONDITION THAT COMMENT ON THOSE ISSUES WITH CALLING AND FILLS PHIL IMPACT FEES. THE VILLAGE RIGHT NOW DOES NOT HAVE IMPACT FEES YOU KNOW, DEVELOPERS WOULD PAY IMPACT FEES. UM. TWO ON LEE MARTIN COUNTY, SO WE WANTED THEM CHANGE THAT CHANGE, TOO.

WHEN THE VILLAGE INSTITUTES AROUND IMPACT FEES ANY DEVELOPERS WOULD PAY US DIRECTLY OR ANY PROJECT WITHIN THIS DEVELOPMENT. UM. NOTHING NOTHING SUBSTANTIAL, SUBSTANTIAL WITH IRRIGATION, BUT THEY REQUESTED SOME AMENDMENTS. LAND OF THEM AND USES WERE ASKING IF THEY COME IN FOR REPLANTING. THEY DO CERTAIN THINGS. UM A COUPLE OF SECTIONS HAVE JUST GONE AWAY. THEY'RE BEING DELETED PERMIT READY PROCESS WILL NOT HAPPEN.

UM ANYMORE. SO ANY ANY INDIVIDUAL DEVELOPER COMING IN TO DEVELOP THIS SITE WOULD JUST COME IN AND GET THEIR OWN BUILDING PERMIT AS USUAL. THERE'S SOME CHANGES TO THE SIDEWALK PROVISION. THE APPLICANT I BELIEVE IS ON ON HE COULD EXPLAIN WHAT THEY'RE PROPOSING NOW. WHICH IS BASICALLY THE PROPOSING TO GO BACK TO THE ORIGINAL LANGUAGE OF THE DOCUMENTS. SO, UM I THINK THEY COULD ADDRESS THAT A LITTLE MORE. SECTIONS 11 AND 12, WHICH DEALS WITH TEMPORARY CONSTRUCTION AND SALES OFFICES ON SITE. WE HAVE THAT IN THERE ARE CODE. WE DON'T NEED THAT IN THIS DOCUMENT ANYMORE. IT JUST FILLS UP. MORE PAGES, SO IT'S IN OUR CODE, SO RECOVERED WITH THAT. UM THERE WAS ANOTHER CHANGE TO SECTION 13, WHICH DEALS WITH TRAFFIC AND CURRENCY. AND A REQUIREMENT OF TRAFFIC STUDIES FOR THE WHOLE PROJECT AND THEN INDIVIDUAL APPLICANTS SO AS A CONDITION THERE'S SOME NEW LANGUAGE IN THAT. PART OF THIS DOCUMENT THAT ADDRESSES WHAT EVERYONE'S AGREED TO UM. AND LASTLY, THE LAST SECTION OF CONDITIONS DEALS WITH WASTE WATER AND WASTEWATER AND AGAIN, AS I STATED ORIGINALLY, THE PD WAS ONLY REQUIRED TO HOOK UP TO WATER AND SEWER WHEN THEY WERE WITHIN 150 FT. OF THE PROPERTY, SO THEY'VE AGREED TO CHANGE THAT TO THE QUARTER MILE. S SO BASICALLY AGAIN OUR RECOMMENDATION IS FOR APPROVAL, WITH SOME CONDITIONS TONIGHT.

AND IF YOU REQUEST ANY OTHER CONDITIONS, THEN THAT WOULD BE ADDED TO THE REPORT THAT GOES TO THE COUNCIL. SO BASICALLY THE ONE CONDITION IS THE DOCUMENT HAS TO BE RECORDED WITHIN 14 DAYS OF APPROVAL. THAT WARNING BE CHANGED HAD THE FUTURE IMPACT VILLAGE OF INDIA 10 IMPACT FEES. ALSO THE NEW TRAFFIC STUDY LANGUAGE, WHICH READS A TRAFFIC STUDY IDENTIFYING THE IMPACT SHALL BE PROVIDED PRIOR TO INFLUENCE OF A DEVELOPMENT ORDER. THE TRAFFIC STUDIES SHALL INCLUDE THE CUMULATIVE IMPACTS OF PREVIOUSLY APPROVED SITE PLANS WITHIN THE P UT SO BASICALLY THE FIRST PERSON COMES IN DEVELOPS. THEY HAVE TRAFFIC.

I DO HAVE AN EMAIL FROM THE PUBLIC WORKS DIRECTOR IS SAYING THAT THEY WOULD IF WE PAID A FEE IN LIEU OF THAT CONSTRUCTION OF THAT SIDEWALK, THEY WOULD USE THAT MONEY TO REPAIR SIDEWALKS AND OTHER AREAS OF INDIAN TOWN.
